Terms of Service

These Terms apply globally. Additional rights may apply depending on your jurisdiction — see Section 14 (Jurisdiction-Specific Terms).

1. Acceptance of Terms

By accessing or using iErase (“Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These Terms apply to all users, including free scan users and paid subscribers, in all jurisdictions.

2. Description of Service

iErase is a privacy management service that scans data broker websites for your personal information and submits opt-out and removal requests on your behalf. We use automated scanning, AI-generated reports, and manually-reviewed removal requests.

3. Free Scan

The free scan is available to all users without payment. It provides a report of data broker exposures. Actual removal requests require an active paid subscription. Free scan results are stored for 90 days, after which they may be deleted unless you create an account.

4. Subscriptions & Billing

  • Subscriptions are billed monthly or annually at the rates shown on our pricing page
  • A 7-day free trial is available for new subscribers — no charge until day 8
  • You may cancel anytime from your dashboard — access continues until the end of the billing period
  • Refunds are handled on a case-by-case basis — contact support@ierase.ai within 14 days of charge
  • Prices may change with 30 days advance notice to subscribers
  • EU/UK users: You have a 14-day statutory right of withdrawal from paid subscriptions under consumer protection law

5. User Responsibilities

You agree to:

  • Provide accurate personal information for the scan and removal requests
  • Use the Service only for your own personal data removal (or for an immediate family member with their consent)
  • Not use the Service to submit removal requests for other people without their explicit authorisation
  • Keep your account credentials secure and notify us immediately of any unauthorised access
  • Not use the Service for any unlawful purpose or in violation of these Terms
  • Not attempt to reverse engineer, scrape, or misuse our systems

6. Consent & Data Processing

By submitting a scan request, you provide explicit consent for iErase to process your personal data for the purpose of finding and removing your information from data broker websites. This consent is required for us to legally submit removal requests on your behalf. You may withdraw consent at any time by deleting your account; however this will stop ongoing removal services.

You authorise iErase to act as your agent for the limited purpose of submitting data removal and opt-out requests to data brokers. This does not grant us any other authorisation over your identity or personal information.

7. Identity Documents

Some data brokers require proof of identity to process removal requests. If you choose to upload a government-issued ID, it will be stored securely, used only for submitting removal requests, and deleted within 90 days of upload. You are not required to upload ID — doing so may improve removal success rates for certain brokers.

8. Results Disclaimer

We make our best efforts to remove your data from all identified sources. However, we cannot guarantee complete removal from all sources. Data brokers operate independently and have their own removal timelines (typically 7–30 days, sometimes longer). New data may appear over time as brokers refresh databases — this is why ongoing monitoring is included in your subscription. iErase is not liable for delays or failures attributable to third-party data brokers.

9. Intellectual Property

All content, software, technology, and branding on the iErase platform is owned by iErase and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable law, iErase's liability is limited to the amount you paid for the Service in the 12 months prior to the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of data, income, or profits. The Service is provided “as is” without warranty of any kind.

Some jurisdictions (including EU consumer protection law) do not allow exclusion of certain implied warranties or limitation of liability — in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity, with or without notice. You may delete your account at any time from your account settings. Upon termination, your personal data is deleted per our Privacy Policy retention schedule.

12. Dispute Resolution

We prefer to resolve disputes amicably. Please contact support@ierase.ai before initiating any legal proceeding. For users in the EU, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Governing Law (Default)

Subject to Section 14, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Jurisdiction-Specific Terms

European Union / EEA / United Kingdom

  • These Terms do not affect your mandatory statutory rights under EU/UK consumer protection law
  • You have a 14-day cooling-off period for digital service subscriptions
  • Any dispute may be brought before the courts of your country of residence
  • GDPR rights apply as described in our Privacy Policy
  • UK users: governed by UK GDPR and applicable UK consumer law

California, United States

  • CCPA/CPRA rights apply — we do not sell your personal information
  • California residents may contact us to exercise rights under CCPA

Canada

  • PIPEDA applies to Canadian users — see Privacy Policy for details
  • Quebec users: Law 25 (Bill 64) rights apply

Australia

  • Australian Consumer Law guarantees apply and cannot be excluded
  • Privacy Act 1988 (Cth) rights apply to Australian users

Japan

  • Act on the Protection of Personal Information (APPI) rights apply
  • We handle personal data in accordance with APPI requirements

Singapore

  • Personal Data Protection Act (PDPA) 2012 rights apply
